French Court Alters Interoperability Law

The French constitutional court has struck down key parts of the controversial interoperability law which had been approved by the French Senate and National Assembly last month. The original interoperability law required online music stores like Apple to submit the Digital Rights Management (DRM) codes of iTunes, to a government agency to make them compatible with all portable music devices. Politicians had eventually watered it down after Apple threatened to leave the country, but the final court ruling on Thursday rendered the law unconstitutional.

The French court stated that the interoperability bill was not clearly defined and that it had many loopholes. Besides, the court referred to the 1789 Declaration on Human Rights and concluded that the law also violated the constitutional protections of property. The court has eliminated fines for file sharing and said companies could not be forced, without compensation, to make music sold online compatible with any music device.Read more here.
